Terms of use for 80k

80k.ch is a Swiss marketplace dedicated to connecting sellers and buyers of premium, sports, luxury and collector vehicles from CHF 80'000.

80k.ch is neither a seller, nor a buyer, nor an agent, nor a payment intermediary between the parties. The platform only provides a space for publishing and connecting. The sales contract is concluded exclusively between the Seller and the Buyer.

An account may be created by registration or by invitation. The user chooses their own password, which remains strictly personal and is never communicated to 80k.ch. The user is responsible for the confidentiality of their credentials and for any activity carried out from their account.

The information provided must be accurate and kept up to date. 80k.ch may request identity verification and suspend or delete an account in the event of false information, abuse or breach of these Terms.

The Seller warrants that they are entitled to sell the vehicle listed and that the information, photos and documents published are accurate, complete and not misleading. Unlawful, counterfeit, defamatory content or content infringing the rights of third parties is prohibited.

80k.ch reserves the right to refuse, modify, unpublish or delete any Listing that does not comply with its quality criteria, its price threshold or these Terms, without compensation.

The subscriptions and publication credits are described on the Sellers page. Prices are indicated in Swiss francs (CHF). Payments are processed by an external payment provider; 80k.ch does not retain any bank card data.

Publication credits are consumed when a Listing is put online and are neither refundable nor transferable, unless otherwise provided by mandatory law. Listings whose rights have expired are hidden.

The following are in particular prohibited: publishing false Listings, abusive commercial solicitation, automated data collection, attempts at unauthorised access, and any use likely to disrupt the operation of the platform.

80k.ch implements reasonable means to ensure the availability and quality of the service, without any guarantee of the absence of interruption or error.

To the extent permitted by Swiss law, 80k.ch's liability is excluded for indirect damages, loss of profit or disputes arising between Sellers and Buyers, in particular regarding the condition, origin or conformity of a vehicle.

The trademark, logo, structure and content specific to 80k.ch are protected. By publishing a Listing, the user grants 80k.ch a non-exclusive and royalty-free licence to use the content provided for the purposes of operating and promoting the platform.

The processing of personal data is described in the privacy policy.

80k.ch may amend these Terms at any time. The version published on this page prevails. In the event of a substantial change, users are informed by an appropriate means.

These Terms are governed by Swiss law. Subject to mandatory jurisdictions, the exclusive place of jurisdiction is the registered office of the operator in Switzerland.
